Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and FiveToClose (“Company,” “we,” “us,” or “our”) governing your access to and use of wheretheyask.com and the WhereTheyAsk application (collectively, the “Services”). By creating an account or signing in, you represent that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms. If you do not agree, do not use the Services.

2. Description of services

WhereTheyAsk is a free community. You get a profile, a feed, pages, groups, events, and live rooms. Sign-in is Google, then a confirmation link sent to that email. You can also sign in with a one-time link sent to an email address you enter. Resend sends that link. We create the account when you open the link. The Constitution of the United States is the law of this site. We believe in freedom and in America. The First Amendment and the Second Amendment are upheld vehemently. Lawful speech stays up. Lawful pictures of guns and shooting stay up. Killing and suicide do not go up.

You can choose to add an event to Google Calendar. That sends its details to Google.

Act your age. Act like an adult, not a child. Do that and you will be fine. Harassment reports and other support issues go to support@fivetoclose.cloud. That address is for these legal pages and for mail we send. It is not a public sales address.

3. Accounts and eligibility

You must be at least eighteen (18). You sign in with a Google account you are allowed to use, then you open the confirmation link we email to that address. You can instead sign in with an email address you are allowed to use. We send a one-time link, and the account starts when you open it. You are responsible for activity under your account. If the account is compromised, email support@fivetoclose.cloud. Lawful speech stays up. Lawful pictures of guns and shooting stay up. Selling is allowed. We remove posts about killing and suicide. We remove content that is illegal under the Constitution and the laws of the United States. Accounts that break these rules are removed.

We only ban people that are reported. We investigate the claim, and we have 7-10 business days to ban after we ask them to take the content down. Nude photos are not encouraged, but if posted and reported, we will intervene if asked. We also will ban people per our earlier note about no self harm, no harming others, and no terrorist activities.

4. Price

The Services are free. There is no charge for a profile, a page, a group, an event, or a live room. Advertising may be sold later, after there is an audience. It is not sold now.

5. License and intellectual property

The Services, including software, copy, trademarks, and trade dress, are owned by FiveToClose or its licensors. We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services.

You may not resell the Service, scrape it, reverse engineer it, or use it to build a competing product.

You retain rights in content you submit. You grant us a limited license to host and show that content so the Services work for the people allowed to see it.

6. Acceptable use

Act like an adult. The Constitution of the United States is the law of this site. You may speak, sell, and show lawful guns and shooting. You may post pictures, video, and audio. All-out pornography does not go up. Killing and suicide do not go up. Sexual content involving minors is illegal and does not go up. Accounts that break these rules are removed. Groups and pages can be open to anyone, or limited to the owner and people who enter a code the owner shares. Open discussion is encouraged.

Illegal content
Threats and harassment
Sexual content involving minors
Scams and fraud
Malware
Counterfeits
Self harm
Terrorism

Reported content is hidden until we review it. We typically review reports within 48-72 hours. That is a target, not a promise. The owner may delete the content immediately, may give a warning (three strikes and the account is removed), and may remove an account immediately for serious violations (illegal content, threats, self harm, terrorism, sexual content involving minors).

Reports are for signed-in members. Use the Report link on a post, comment, page, group, or profile. Copyright notices can be sent by anyone via the copyright form or support@fivetoclose.cloud. A block or a mute is not a report. It is not sent to the review team.

Members earn no income promise. Nothing on the site is a guarantee of earnings.

If a post offends you, you can leave. BlueSky and other places exist for people who want a tighter room. We do not take a post down because someone is offended. Harassment reports go to support@fivetoclose.cloud.

7. Your posts

You are responsible for what you post, including pictures, video, audio, and live video. We do not log into your other accounts. Lawful speech, selling, and lawful pictures of guns and shooting are allowed. Nude photos are not encouraged, but if posted and reported, we will intervene if asked.

7A. Messages

New direct messages are encrypted in your browser before they are sent. We still see who messages whom, when, read receipts, and notifications. Older messages and event details are not end-to-end encrypted, and WhereTheyAsk can read them. If the law requires it, we comply and hand over the data we hold. A valid court order or other legal request is enough. We do not promise to tell you when that happens. This version has no forward secrecy, a lost passphrase means lost history, and our site delivers the encryption code. This is not Signal-level protection. If being watched could put you in danger, use an app built for that, such as Signal.

When auto-delete is on for a chat, it applies to both people. Copies and screenshots outside our server are outside our control.

8. No warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT A POST, PAGE, GROUP, EVENT, OR LIVE ROOM WILL PRODUCE AN AUDIENCE, TRAFFIC, CUSTOMERS, REVENUE, OR ANY PARTICULAR OUTCOME. THIRD-PARTY SITES MAY CHANGE OR FAIL.

WE DO NOT WARRANT CONFIDENTIALITY OF DIRECT MESSAGES, EVENT DETAILS, OR ANYTHING SENT TO GOOGLE CALENDAR. GOOGLE HOLDS CALENDAR AND GMAIL DATA. WE CANNOT ENCRYPT OR DELETE IT THERE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVETOCLOSE AND ITS OFFICERS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ACCOUNTS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, REGARDLESS OF THEORY OF LIABILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless FiveToClose and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, content you submit or publish, your violation of these Terms, or your infringement of any third-party right.

11. Third-party services

Sign-in uses Google, or a one-time link sent by Resend. If you choose to add an event to Google Calendar, Google holds that event and any invite sent from Gmail. We cannot encrypt or delete them there. A pasted webinar link plays on that host. Your use of those services is governed by their terms. We are not responsible for third-party acts, outages, or policy changes.

12. Modifications

We may modify the Services or these Terms at any time. Material changes will be indicated by updating the effective date. Continued use after changes become effective constitutes acceptance of the revised Terms.

13. Governing law and disputes

The Constitution of the United States is the law of this site. These Terms are governed by the Constitution and the laws of the United States. The speech and arms rules above follow the First Amendment and the Second Amendment. Courts in the United States are the venue for disputes, except where a consumer-protection statute requires otherwise.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FiveToClose regarding the Services and supersede prior understandings on the same subject.

A notice needs your name, email, the link to the content, what is yours, a good-faith statement, a statement that the notice is accurate, and your signature. A copyright notice is reviewed by the owner. It does not hide the content by itself.
